Welcome to Jeep Cape Xplorer. By booking a tour, accessing our website, or using our services, you agree to the following Terms and Conditions.

1. Bookings and Payments

• All bookings are subject to availability.
• A deposit or full payment may be required to confirm your booking.
• Prices are quoted in South African Rand (ZAR) unless otherwise stated.
• Payments may be made via EFT, Yoco, cash, or approved payment methods.

2. Cancellation Policy

• Cancellations made 7 days before the scheduled tour may qualify for a partial or full refund.
• Cancellations made within 48 hours of the tour may be non-refundable.
• JeepCapeXplorer reserves the right to cancel or reschedule tours due to weather conditions, safety concerns, vehicle issues, or unforeseen circumstances.

3. Tour Participation

• Guests participate in tours and activities at their own risk.
• Guests must follow all safety instructions provided by the guide or driver.
• JeepCapeXplorer reserves the right to refuse service or participation to any guest whose conduct may endanger themselves, staff, or other guests.

4. Health and Safety

• Certain activities may not be suitable for pregnant guests, guests with medical conditions, or young children.
• Guests are responsible for informing JeepCapeXplorer of any relevant medical conditions or physical limitations before the tour.

5. Liability

• JeepCapeXplorer is not liable for loss, theft, damage to personal belongings, injuries, delays, accidents, or events beyond our reasonable control.
• Guests acknowledge that outdoor and adventure activities involve inherent risks.

6. Privacy Policy

• JeepCapeXplorer respects your privacy and is committed to protecting your personal information.
• Personal information collected during bookings or inquiries may include your name, phone number, email address, pickup location, and payment information.
• Information collected will only be used for booking management, communication, customer support, and service improvement purposes.
• JeepCapeXplorer will not sell or unlawfully share your personal information with third parties.
• By using our services or website, you consent to the collection and use of your information in accordance with this policy.

7. User Content

• Guests may post reviews, comments, photos, videos, or other content related to their experience with JeepCapeXplorer.
• By sharing content and tagging JeepCapeXplorer, you grant JeepCapeXplorer permission to repost, share, or use such content for marketing and promotional purposes unless you request otherwise in writing.
• Users are responsible for ensuring that any content they submit does not violate the rights of others.

8. Inappropriate Content

• Users may not post, upload, share, or distribute unlawful, offensive, abusive, discriminatory, defamatory, explicit, or harmful content related to JeepCapeXplorer platforms or services.
• JeepCapeXplorer reserves the right to remove inappropriate content and restrict access to users who violate these standards.

9. Indemnity

By using JeepCapeXplorer services, guests agree to indemnify and hold harmless JeepCapeXplorer, its owners, employees, guides, affiliates, and partners against any claims, damages, liabilities, costs, or expenses arising from:

• Participation in tours or activities
• Violation of these Terms and Conditions
• Negligent or unlawful conduct by the guest
• Damage caused to vehicles, property, equipment, or third parties

10. Photography and Media

• Photos and videos taken during tours may be used by JeepCapeXplorer for marketing, promotional, website, and social media purposes unless guests request otherwise in writing before the tour.

11. Pick-Up and Arrival

• Guests must be ready at the agreed pickup location and time.
• Delays caused by late arrivals may reduce tour time without refund.

12. Governing Law

• These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa.
• Any disputes arising from the use of JeepCapeXplorer services shall be subject to the jurisdiction of South African courts.

13. Changes to Terms

• JeepCapeXplorer reserves the right to update or modify these Terms and Conditions at any time without prior notice.

14. Vehicle Damage

• Guests renting or using JeepCapeXplorer vehicles agree to treat all vehicles, equipment, and accessories responsibly and with care.
• Any damage caused to the vehicle during the rental or tour period due to negligence, reckless behaviour, misuse, driving under the influence, or violation of safety instructions may result in the guest being held financially responsible for repair or replacement costs.
• This includes, but is not limited to:
  • Interior damage
  • Exterior scratches or dents
  • Tyre and wheel damage
  • Broken accessories or equipment
  • Sand, water, or off-road misuse damage
  • Excessive cleaning costs caused by negligence
• Guests may also be held responsible for towing fees, recovery costs, traffic fines, or loss of income while the vehicle is under repair if applicable.
• JeepCapeXplorer reserves the right to inspect vehicles before and after each rental or tour.
• Drivers must hold a valid driver’s licence and comply with all South African road laws and safety regulations.
• Jeep rentals may require a refundable security deposit before vehicle handover.
• JeepCapeXplorer reserves the right to refuse vehicle rental to any individual deemed unfit, unsafe, or in violation of these Terms and Conditions.

This section is important because Atlantis Dunes and off-road driving can easily lead to tyre damage, clutch damage, sand recovery costs, and underbody damage.
